1. Who We Are

You must be 21+ years of age or older to use this website. These Terms of Service (“Terms”) govern your access to, and use of the website(s) www.caligulas.casino & www.caligulas.com, and any related mobile applications, platforms, and services (collectively, the “Services”). By using this website, you agree to these Terms, our Privacy Policy, and Game Rules. If you do not agree with any of these policies, you must not use this site.

Caligula’s Entertainment Ltd. is the operator of a land-based casino in The Bahamas and, once authorized, an interactive gaming operator under a restricted interactive gaming licence issued pursuant to the Gaming Act, 2014 (Ch. 388) of The Bahamas (the “Gaming Act”).

References to “Caligula’s”, “we”, “our” or “us” mean Caligula’s Entertainment Ltd. References to “you” or “your” mean the individual using the Services.

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. Eligibility, Age, & Jurisdiction

2.1 Minimum age

You may only use the real-money gaming elements of the Services if:

  • You are at least twenty-one (21) years old, or

  • Such higher minimum age as required by the laws of the jurisdiction where you are physically located at the time of play.

You must truthfully confirm your age during registration. We may request proof of age and identity at any time and may suspend or close your account if you do not provide satisfactory evidence.

2.2 Jurisdictional restrictions

You may only use the real-money gaming Services where such use is lawful in the jurisdiction where you are physically located and in accordance with the Gaming Act and any conditions of our licences in The Bahamas.

Without limiting the generality of the foregoing:

  • The Services are not offered to persons in any country or territory where online gambling is prohibited.

  • We may designate a list of “Permitted Foreign Jurisdictions” (as that term is used in the Bahamian Gaming Bill and Gaming Act) whose citizens may engage in interactive gaming with an operator located in The Bahamas.

  • If you are physically located in the United States, you must not use the real-money gaming Services unless and until we expressly notify you that specific games are legally available to you under applicable U.S. federal, state, tribal and local laws.

You are solely responsible for ensuring that you are not in breach of any law by accessing the Services. We do not guarantee that the Services are legal or appropriate for use in your jurisdiction.

2.3 Prohibition on unlawful internet gambling

We will not knowingly accept deposits or payments in violation of the U.S. Unlawful Internet Gambling Enforcement Act of 2006 (“UIGEA”), which prohibits gambling businesses from knowingly accepting certain financial instruments (including credit cards and certain electronic fund transfers) in connection with unlawful internet gambling under applicable federal or state law.

You agree not to attempt to use the Services from any jurisdiction where doing so would cause you or us to violate UIGEA or any other law, including by using VPNs, proxies, or fraudulent address or geolocation information.

3. Account Registration, Verification, & KYC

3.1 Account creation

To use the real-money portions of the Services, you must create an account and provide accurate, current and complete information, including:

  • Full legal name

  • Date of birth

  • Residential address

  • Email address and contact details

  • Any additional information required for identity verification and regulatory compliance.

3.2 Know-Your-Customer (KYC) & verification

We may verify your identity, age, address, source of funds and other information using third-party providers, consistent with our obligations under The Bahamas’ anti-money laundering and counter-terrorist financing framework and the Gaming Act.

You consent to our conducting these checks and agree to provide any supporting documentation we reasonably request (e.g., passport, government ID, utility bill, proof of payment method).

We may suspend or terminate your account, withhold deposits and/or winnings, or delay withdrawals if:

  • We cannot verify your information,

  • We suspect fraud, money laundering, terrorist financing, or other criminal activity, or

  • We consider that you have breached these Terms or applicable law.

3.3 Single account and account security

You may hold only one account with us unless we explicitly agree otherwise in writing. You must not allow any other person to use your account, and you are responsible for maintaining the confidentiality of your login credentials and for all activities under your account.

4. Deposits, Wagering, & Withdrawals

4.1 Deposits

You may deposit funds into your account using payment methods we make available from time to time. We may impose minimum and maximum deposit limits. Certain payment methods may only be available in specific jurisdictions.

We reserve the right to refuse any deposit where required for compliance with the Gaming Act, anti-money laundering obligations, UIGEA, or other applicable law.

4.2 Wagering

All wagers are subject to:

  • The specific game rules,

  • Any posted house rules or bonus terms, and

  • The technical availability of our systems.

A wager is only accepted once it is recorded on our servers. In the event of a dispute over any bet or game outcome, our logged record of the transaction will be considered the final and binding record, subject to your statutory rights.

4.3 Withdrawals

You may request withdrawals of available funds subject to:

  • Any applicable minimum or maximum withdrawal limits;

  • Completion of required identity and payment method verification;

  • Compliance with anti-money laundering controls; and

  • Any wagering requirements attached to bonuses.

4.4 Transactions

All transactions are final, and non-refundable.

  • All transactions are subject to Game Rules.

  • Caligula’s Entertainment Limited or their payment processor(s) reserve the right to refuse payment for any lawful reason, including violating the Game Rules, by cheating, or otherwise manipulating gameplay mechanics. In such an event, your withdrawal will be placed on hold pending investigation by our Security Team.

  • Transactions will appear as “ROCKETPOWER” or “HOTDOGROCKETSHIP” on your credit card/bank statements.

We may, to the extent permitted by law, offset any amounts you owe us (e.g., chargebacks, fraud losses, or errors) against your account balance.

5. Bonuses, Promotions, & Loyalty Programs

From time to time, we may offer bonuses, free spins, promotional credits, and loyalty programs. Each promotion will be subject to specific terms (e.g., eligibility, wagering requirements, expiry).

  • If promotional terms conflict with these Terms, the promotional terms will prevail to the extent of the conflict.

  • We may modify or withdraw promotions at any time, except where prohibited by law.

6. Prohibited Conduct

You agree that you will not:

  • Breach these Terms, the Gaming Act, or any other applicable law;

  • Use the Services if you are underage or located in a prohibited jurisdiction;

  • Open multiple accounts or impersonate any person or entity;

  • Use bots, scripts, or automated tools to play or interact with the Services;

  • Engage in cheating, collusion, arbitrage between multiple accounts, or advantage play that exploits obvious errors;

  • Attempt to interfere with the proper functioning of the Services, including hacking, reverse engineering, or denial-of-service attacks;

  • Use the Services for money laundering, terrorist financing, fraud or any unlawful purpose.

We may investigate suspected violations, suspend or close accounts, and report suspicious activity to relevant authorities.

7. Intellectual Property

All content on the Services (including logos, trademarks, trade names, graphics, text, interfaces, game designs, software, and underlying code) is owned by us or our licensors and is protected by copyright, trademark and other intellectual property laws.

You are granted a limited, revocable, non-exclusive, non-transferable licence to access and use the Services for personal entertainment only, in accordance with these Terms. You may not use any content for commercial purposes without our prior written consent.

8. Responsible Gaming

We aim to promote responsible gaming. Among other measures, we may:

  • Offer self-exclusion and “cool-off” tools;

  • Permit you to set deposit, loss or session limits;

  • Provide links to responsible gambling organizations and helplines.

We are not a medical or therapeutic provider and do not offer professional advice. If you believe you have a gambling problem, you should seek help from qualified professionals in your jurisdiction.

9. Disclaimers & Limitation of Liability

9.1 No guarantee of winnings

Gambling entails financial risk. You may lose some or all of the money you wager. You acknowledge that:

  • Outcomes of games of chance are random and governed by approved random number generators and house rules; and

  • Past performance or outcomes do not guarantee future results.

9.2 Service “as is”

To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

9.3 Limitation of liability

To the maximum extent permitted by law, in no event will we, our group companies, directors, officers, employees, partners or agents be liable for:

  • Any indirect, incidental, special, consequential or punitive damages; or

  • Any loss of profits, revenue, data, or goodwill,

arising out of or in connection with your use of the Services, whether based in contract, tort (including negligence), strict liability or otherwise, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising out of or relating to the Services or these Terms will not exceed the greater of (a) the amount you have actually paid to us in the twelve (12) months before the claim arose, or (b) one hundred United States dollars (US$100), except where a higher limit is required by non-waivable law.

Nothing in these Terms limits our liability for fraud, fraudulent misrepresentation, death or personal injury caused by our negligence, or any other liability that cannot lawfully be excluded or limited.

10. Account Suspension, Closure, & Forfeiture

We may suspend or close your account and/or void or withhold wagers or winnings where we reasonably believe that:

  • You have breached these Terms or any applicable law;

  • You are underage or not located in a permitted jurisdiction;

  • You have engaged in fraud, cheating, money laundering or other criminal activity; or

  • There is a technical or manifest error in game operation or odds.

If we close your account in these circumstances, we will handle your remaining balance in accordance with applicable law and regulatory guidance, which may include forfeiture where legally permitted.

11. Governing Law & Dispute Resolution

These Terms and any non-contractual obligations arising out of or in connection with them are governed by and construed in accordance with the laws of the Commonwealth of The Bahamas, without prejudice to any mandatory consumer protection laws that apply in the country where you habitually reside.

You agree that, subject to any regulatory processes or mandatory local rights, the courts of The Bahamas will have exclusive jurisdiction to resolve any dispute arising from or relating to these Terms or the Services.

12. Changes to These Terms

We may modify these Terms from time to time, for example to reflect changes in:

  • Bahamian law (including the Gaming Act or its regulations);

  • Data protection laws in The Bahamas or other jurisdictions;

  • Our business practices or service offerings.

Where required by law, we will notify you of material changes in advance (for example via email or prominent notice on the Site). Your continued use of the Services after changes take effect constitutes your acceptance of the updated Terms.
